By proceeding with services from Yogability Australia Pty Ltd, you agree to these terms of service. You acknowledge that Yogability Australia Pty Ltd and its representatives will provide services in line with the following NDIS support categories within Yogability Australia Pty Ltd’s NDIS Provider Registration:
1. Service Delivery and Billing
Scheduled online sessions will be billed at a minimum of 2 hours. Face-to-face services will be billed at a minimum bill amount of 3 hours, including travel unless a higher minimum is specified. All prices are based on the NDIS price guide rates and will be adjusted according to NDIS price guide increases. Disability support services will be delivered a minimum of once a week once services commence unless otherwise specified.
Yogability Australia Pty Ltd follows the NDIS price guide cancellation policies for scheduled services. Prices are billed based on the carer-to-participant ratio in line with the NDIS price guide for the above support categories, applicable respite day rates, sleep over rates, or hourly rates unless otherwise specified by Yogability Australia Pty Ltd in writing. All kilometers travelled will be billed in line with the NDIS price guide. All Kilometers travelled on respite will be billed. Payment for services will be sought weekly. If payments are not made on time and Yogability Australia Pty Ltd must implement debt recovery procedures, the client will be liable for interest on the outstanding debts and legal costs associated with recovering the money.
2. Liability
By participating in services with Yogability Australia Pty Ltd, you agree to release Yogability Australia Pty Ltd and its representatives from any liabilities resulting from the participant's behavior. You also agree that the participant is physically able to engage in yoga and waive any liability for injuries that may occur during disability support sessions or respite services delivered by Yogability Australia Pty Ltd and its representatives.
3. Privacy and Consent
We collect your personal information to provide you with tailored supports and services. Without this information, we may not be able to fully meet your needs. We use your information for:
We protect your privacy, and our policy is available upon request. By proceeding with services, you consent to providing your information and allowing us to access your NDIS plan and budget. You agree to monitor your budget to ensure adequate funding is available.
4. Dispute Resolution
In the event of a dispute between you and Yogability Australia Pty Ltd, we encourage you to contact us to discuss the matter at info@yogability.com.au. If the issue cannot be resolved through discussion, we may suggest mediation or another form of alternative dispute resolution before pursuing any legal action.
5. Termination of Services
The participant may terminate the service by providing 30 days notice in writing sent to info@yogability.com.au. Yogability Australia Pty Ltd reserves the right to waive the notice period of the client at its discretion. Yogability Australia Pty Ltd reserves the right to terminate services at it’s discretion, immediately in cases of non-payment, inappropriate behaviour, or if the participant's health or safety is at risk.
6. Changes to Terms of Service
Yogability Australia Pty Ltd reserves the right to modify these terms of service at any time. Changes will be posted on our website and take effect immediately. Your continued use of our services after such changes have been posted will constitute your acceptance of the revised terms.

Yogability Australia Pty Ltd is not liable for any failure to perform its obligations under these terms if such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, or other emergencies.
9. Service Availability
Yogability Australia Pty Ltd commits to making every reasonable effort to ensure that services are available. However, there may be occasions when services are delayed, postponed, paused or cancelled due to unavailability of team members or other operational considerations. In such cases, we will endeavour to notify affected participants as soon as possible and attempt to reschedule or make alternative arrangements where possible. Yogability Australia Pty Ltd is not liable for any failure to perform its services due to unavailability of team members or other internal operational challenges.
10. Mindful Yoga Carers
10.1 Engagement and Roles
Mindful Yoga Carers, engaged by Yogability Australia Pty Ltd, deliver care and support under our programs. They adhere to a specific contractor agreement in the Mindful Yoga Carer Terms, which details their roles, responsibilities, and conduct standards. A copy of this agreement / terms is available here for review.
10.2 Availability and Assignment Changes
We endeavor to ensure adequate availability of Carers to meet client needs. If a suitable Carer is not available, we will seek alternative arrangements when possible. If a Carer who has been supporting you is no longer available, feel free to reach out to info@yogability.com.au or enquire on a profile of a Yoga Carer you might like to work with and we will attempt to reassign you to someone available. Yogability Australia Pty Ltd reserves the right to reassign Carers as needed based on operational requirements.
10.3 Interactions and Conduct
Clients are expected to treat Carers with respect and report any service issues to management via info@yogability.com.au. Carers must maintain professionalism, client safety, and adhere to confidentiality standards set by our privacy policy.
By using our services, clients acknowledge and accept the terms related to the engagement and conduct of Mindful Yoga Carers.
11. Governing Law
These terms of service are governed by the laws of Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts in this jurisdiction.
